The court date to sentence former Santa Clara City Council Member Anthony Becker has been delayed by two months. His new court date is March 21, 2025.
Becker was supposed to be sentenced on Jan. 31 on charges of perjury and violation of duty for leaking the civil grand jury report entitled “Unsportsmanlike Conduct” to local media and the 49ers.
Becker was convicted by a jury of his peers in a weeks-long trial that concluded on Dec. 5, 2024. Deliberations took just a few hours. He was scheduled for a sentencing date that same day and told to report to probation. He was free to leave the courtroom until his scheduled sentencing date.
Felony perjury carries with it a maximum of four years in prison, though it will be up to the judge in the case to determine whether Becker serves prison time and, if so, how much.
After the verdict was read, Santa Clara County District Attorney Jeff Rosen addressed the media and said he did not believe state prison time was required.
“I don’t think this is a state prison case, but in terms of what the level of accountability is, we’ll see what the probation report shows,” said Rosen. “I think there does need to be some accountability, whether that’s a combination of jail time and fines because this is very serious, what the defendant did.”
Rosen has not said since then whether he will ask the judge for jail time.
Just two days after the hearing, Becker officially resigned from his position as the representative of District 6 on the Santa Clara City Council. Since he had not won re-election to the position in November, he would have vacated the seat a few weeks later when the new council was sworn in.
Becker’s attorneys have said in the past that Becker is in the process of appealing the verdict.
