Effective Thursday, Feb. 6, e-cigarette cartridges in all flavors, except menthol and tobacco, are illegal nationwide.
This new Federal “vape” law is intended to limit the sales of flavored vapes to youth, however, the ban only applies to specific types of devices — cartridge and pre-filled pod devices. All other devices, including disposable vapes, will be left on the market.

Back in November, Santa Clara County already banned the sale of e-cigarettes in unincorporated Santa Clara County. On Nov. 5, 2019 the Santa Clara County Board of Supervisors approved a ban on the sale or distribution of e-cigarette devices and associated products. The County also stopped giving out permits for e-cigarette retailers.
Additionally, the City of Santa Clara’s Smoking and Tobacco Regulations Ordinance includes e-cigarettes. Read more about the City’s ordinance on their website.
